BOYNTON BEACH, Fla. — Many people already fear going to the dentist, and it's even scarier when it turns out the office they chose to visit is accused of operating illegally.
That is the reality for at least 80 patients in South Florida, including in Boynton Beach, who detectives said were swindled out of thousands of dollars over a decade-long scheme.
Evelyn Cruz cried in front of a Palm Beach County judge Tuesday morning. She is facing 50 theft and fraud charges and is accused of illegally owning and running the dental office Dental Specialists, with offices in Boynton Beach and three other locations across Broward and Miami-Dade counties.
Detectives say when Cruz was denied a business license for not being a dentist, a requirement to open a practice in Florida, she and her husband Ysmel Cruz illegally used the name of a legitimate dentist, Dr. Ivan Pelton, to open the practices.
Records show Pelton was arrested in December and is facing the same 50 charges as Cruz. They are both being held on a $280,000 bond.
In the arrest reports, investigators say many of the dentists Cruz hired to care for patients were not aware of the situation.
Detectives with the Florida Department of Financial Services have been working on this investigation for more than three years. They say since 2012, when the doors first opened, Cruz's businesses "with illicit proceeds from insurance companies totaled approximately $11,193,782."
At the Boynton Beach location, reports show 11 patients were scammed out of at least $37,000 for "bogus fees," "work not performed," or even "being charged twice for the same procedure."
Cruz sold the Boynton office to the new operator, Care One Dental, in 2019. Court records show Care One discovered the 80 patients who had been defrauded after a thorough review of Cruz's software.
In a statement, they said they are trying to help the victims through "a terrible abuse of trust and a blight on the professional field of dentistry, and we are hopeful full restitution will be made to the patients and families who have been victimized. We would like to make clear, as the press reports their story and shines light on the crimes committed, that neither Care One Dental nor any of its associates have any affiliation with Evelyn Cruz."
Detectives say they still have a warrant out for Ysmel Cruz's arrest.

BOYNTON BEACH, Fla. — Evelyn Cruz appeared in court today, and is accused of defrauding dental patients out of thousands over the course of a decade, via illegally-run clinics.
Jason Tuszynski, who went to the clinic throughout 2021, said he originally went to replace a crown and fill a cavity. But he said he saw “red flags” when the dentist told him 14 teeth needed treatment.
“I remember the head dentist was literally leaned up against the chair with the pliers trying to crack this tooth out,” said Tuszynski. “It was probably the most nerve racking [thing] of the entire experience.”
He said he spent $7,000 on various medical bills, which required a payment plan. Then, Tuszynski said his bill showed he was charged for procedures and appointments that never occurred.
“I think the most frustrating part for me was how many times I had to come in, the inexperience of the dentists that were there and the financial obligation,” Tuszynski said.
Detectives with the Florida Department of Financial Services said Tuszynski was overcharged about $1,400. The detectives said he was 1 of 80 different patients defrauded.
According to court records, detectives said the Secretary of State Office denied Ysmel and Evelyn “Martinez” Cruz business licenses for dental offices. Those detectives then said the couple used Dr. Ivan Pelton's license with his knowledge to create various offices.
“In a recorded statement, Pelton made a spontaneous utterance that he does not have ownership of any of the Dental Specialists corporations and further elaborated that Evelyn Cruz is the owner,” wrote detective Jerome Rothman. “Pelton was aware Cruz was using his dental license.”
Bankruptcy filings in August 2020 show Pelton owned various dental practices, which agents mention in the probable cause document. This includes Dental Specialists of Boynton Beach, Dental Specialists of Pembroke Pines Group, Dental Specialists of Broward Group and Dental Specialists of Doral Group.
Records show he was in debt worth more than $200,000 after spending money on various consumer goods and almost $50,000 in car loans. The filings in federal court show his financial problems with the Internal Revenue Service (IRS) started as early as 2010.
WPTV reached out to Dr. Pelton to learn more about his involvement and motive, which investigators said included accepting payments worth $60,000 for connecting his name and license to the practices across Florida.
He didn’t answer. But his wife, Fern Pelton, said Dr. Pelton worked for the Cruzes and didn’t own the practice before hanging up on WPTV’s Ethan Stein.
According to the Florida Department of Health, Dr. Pelton can still practice in Florida. His license also said he has no complaints.
Since the investigation was done over the last three years, we asked the Florida Board of Dentistry and its chair about the license and we’re waiting to hear back.

BOYNTON BEACH — A group of Boynton Beach condo owners is pushing back on plans for a $8 million safety repair project, alleging that its board has so mismanaged the work that a court-appointed receiver needs to take control of the complex.
At issue is a concrete restoration project at Seagate of Gulfstream, a 50-year-old, five-building community on the Intracoastal Waterway in Boynton Beach that consists of 360 condominiums. Each of the buildings is four stories.
A state law adopted in response to the June 2021 tragic collapse of a 12-story beachfront condo tower in Surfside requires safety inspections and calls for money reserves to be fully funded. The law applies to buildings that are three stories or more in height.

The Palm Beach Post, in a special report published in October, outlined the hardships that the law is causing to many condo owners who say they can't afford to undertake the expensive repairs and fully fund their reserves. Multiple complexes are so unsafe that building officials ordered them evacuated.
The group of owners at Seagate, upset over the cost of the repair work and how it was being done, went so far as to create a limited liability corporation called "The Concerned Owners of Seagate of Gulfstream."
The LLC hired a lawyer and then filed a complaint in Palm Beach County Circuit Court alleging that the engineer hired by the association recommended unnecessary work, and that the contractor overseeing the work failed to monitor it properly.
As a result, many condo owners have had to cope for months with the removal of “screens, hurricane shutters, windows, sliding glass doors, and floor coverings,” the complaint alleges.

Elizabeth Mifsud, a member of the group challenging the association, acknowledged that some of the lanais needed to be boarded while work on the concrete was being done. But the work was supposed to take a few days, she said. Many of the condominiums have been boarded up for months, denying owners access to their lanais.
Mifsud said more than half of the 360 units have joined the owners' group. An effort to recall members from the board failed this year when the board refused to accept the recall petition, according to Mifsud.
The complaint also alleges that contracts for the multimillion-dollar project were awarded without transparency, claiming that the board president signed them without having owners present at a community meeting.

The complaint may be the first of its type. State law requires initial safety inspection reports to be completed by Dec. 31, 2024. The Florida Legislature is expected to determine in 2025 whether the law should be changed to lessen the impact on condo owners.
“There appears to be no end to the cost of the concrete restoration project and the overcharging of fees. FirstService, U.P.E., and Waterfront Services all enjoy a financial benefit from this project and making it as costly as possible,” the complaint said.
Waterfront Services of Lake Park was the firm hired to do the concrete restoration. United Professional Engineering (UPE) of Lake Worth Beach was the firm hired to oversee the work, and FirstService Residential is the management company at Seagate. Efforts by The Post to obtain comment from the condo association, Waterfront Services and FirstService Residential were unsuccessful.
UPE emailed a statement to The Post. It said the contract with the association identified a standard of care to which it had to adhere.
UPE said it "provided services consistent with or exceeding that standard of care. It (UPE) performed many tasks including structural condition assessments, special inspections, and construction administration. The project has progressed in a manner consistent with other similar projects and is targeted to be completed within the overall budget."
The legal action against the Seagate Association also claims that board members Richard Deluca and Don Miller should be removed because they owed the association money when they successfully sought election to the board last February. The association's bylaws say that anyone who is delinquent can not run for a seat on the board.
A complaint was also filed in March with the state Department of Business and Professional Regulation calling for the removal of Deluca and Miller. The agency has yet to issue a decision.
At a board meeting on Dec. 19, residents were informed of the lawsuit, and that a reporter had sought comment from the board. Residents were told that the association was unaware of the lawsuit until the reporter called for comment.
